The litigation process usually begins with the filing of a court action and often continues through the collection of the judgment or pursuit of an appeal. When a lawsuit is initiated by one business or individual against another business or individual and involves a commercial dispute, it is called business litigation. Business litigation often centers on the alleged breach of a contract or terms of the purchase of a product or service. The remedy sought is often damages for the purchase price, the lost profits had the deal been completed or any variety of damages including costs and attorney fees.
Skinner & Skinner provides legal representation in business cases where your company is the victim of a frivolous action or where you or your company must enforce rights or collect on an obligation that it is owed.
Fees and Costs
Attorney fees for handling a business litigation matter are generally calculated on an hourly basis for all work performed by the attorneys in the firm. The client will often be asked to also pay for any fees such as filing fees, process serving, jury fees, costs of exhibits and possibly expert witnesses.
How to Hire the Firm
All new business litigation cases require a meeting with one of our Attorneys for our firm to assist you. When calling the office to schedule an appointment, please be prepared to provide a description of the parties or businesses involved and the nature of the dispute. Please indicate whether or not a lawsuit has been filed and the exact time and circumstances that any legal documents were delivered to you. If you have been legally “served” with the summons and complaint, you may be under a strict time deadline to respond. Failure to timely respond can result in a default being entered against you.
As with all of our new clients, Skinner & Skinner offers free consultations to determine if the firm can assist with your legal needs. Fees are always discussed up front and you will be asked to sign a written retainer agreement outlining all charges and how they will be calculated.
